SHAURMYAN PUBLIC OFFER (TERMS OF USE)

1. General Provisions
This Public Offer (hereinafter referred to as the "Offer") is an official offer by SHAURMYAN (hereinafter referred to as the "Provider" or "we") to any legally competent individual (hereinafter referred to as the "User" or "Customer") to enter into a contract for the provision of food delivery services under the terms and conditions set forth below.
This Offer has been developed in accordance with Articles 447−449 of the Civil Code of the Republic of Armenia, the Law of the Republic of Armenia "On Protection of Consumer Rights," the Law of the Republic of Armenia "On Electronic Commerce," and other applicable legislation of the Republic of Armenia.
Acceptance of this Offer is deemed to be the User’s performance of any of the following actions: registering on the SHAURMYAN website or app, placing an order, clicking the "Place an Order" button, or otherwise confirming the order. Upon acceptance, the Offer becomes a binding contract between both parties.

2. Terms and Definitions
Service — website www.shaurmyan.com
Provider — SHAURMYAN, a company providing services for organizing and delivering orders
User/Customer — an individual who has placed an order through the Service
Order — a list of menu items created by the User, indicating the address and delivery method
Courier — the person who delivers the order
Acceptance — full and unconditional acceptance of the terms of this Offer
3. Subject of the Agreement
The Provider undertakes, upon the Customer’s request, to organize the acceptance, processing, and delivery of orders to the address specified by the Customer, and the Customer undertakes to pay for the services rendered in accordance with the current prices indicated in the Service at the time of order placement.

4. Registration and Account
To place an order, the User may register by creating an account or place an order without registering, if this feature is available on the Service.
When registering, the User must provide accurate and current information: name, phone number, and/or email address. The User is fully responsible for the security of their account login information and for all actions performed using it. If unauthorized access is detected, the User must immediately notify the Contractor.
The Contractor reserves the right to block or delete the account in the event of a violation of the terms of this Offer.

5. Order Process
The User selects items from the menu, adds them to the cart, and specifies the delivery address. Before confirming the order, the User must check the cart contents, delivery address, and total amount. The order is considered completed upon confirmation by the User and receipt of a system notification confirming successful order acceptance.
Once the order is confirmed, its contents cannot be changed. Order cancellation is only possible before the order is transferred for preparation, in accordance with Section 9 of this Offer.
The Provider reserves the right to refuse an order in the event of temporary unavailability of menu items, technical failures, or in other cases stipulated by this Offer. The User will be notified immediately of such refusal.

6. Prices and Cost of Services
Dishes are listed in the Service in Armenian drams (AMD) and include VAT in accordance with the legislation of the Republic of Armenia. Delivery costs are specified separately when placing an order and depend on the address and the terms of any current promotions.
The Provider reserves the right to change prices unilaterally without prior notice. Changes take effect from the moment they are displayed in the Service and do not apply to already confirmed orders.
The minimum order amount, if any, is displayed in the Service upon checkout.

7. Payment
Orders can be paid for in the following ways:
By bank card via the courier terminal upon receipt of the order
Cash to the courier upon receipt of the order
Payment by bank card is due upon receipt of the order. When paying in cash, the User is responsible for ensuring the exact amount is available or notifying the customer of the expected change when placing the order.
If payment is unsuccessful, the order is not considered accepted. If funds are debited in error, the Contractor undertakes to issue a refund within 5 business days of the confirmed request.

8. Delivery
The Contractor delivers to the zones designated in the Service. Actual delivery times may vary depending on traffic conditions, traffic conditions, and other circumstances.
The User is responsible for ensuring availability at the specified phone number and being present at the delivery address during the waiting period. If the User is unable to reach the Customer by phone or refuses to accept the order for reasons beyond the Contractor’s control, the order is considered completed and is non-refundable.
The risk of accidental loss or damage to the order passes to the User upon delivery by the courier.

9. Order Cancellation
The User has the right to cancel the order before it is transferred for preparation. To cancel, please immediately contact customer support via the Service or by phone.
